Third Wave Power warrants the device against defects in materials and workmanship under normal use. The warranty period is 1 year for mPowerpad, mPowerpack and mPowerflash from the date of original purchase. During the warranty period, if a defect arises, and you follow the instructions below for submitting a warranty claim, we will, at our option, either (i) repair the device using either new or refurbished parts or (ii) replace the device with a new or refurbished unit. This limited warranty applies to any repair, replacement part or replacement device for the remainder of the original warranty period or for 30 days, whichever period is longer. All replaced parts and devices for which a refund is given shall become property of Third Wave Power. This limited warranty applies only to hardware components of the device that are not subject to accident, misuse, neglect, fire or other external causes, unauthorized use, alterations or repair, or commercial use.
Submitting a warranty claim
Before you submit a warranty claim, we recommend that you first visit the Troubleshooting section for assistance. Valid warranty claims are generally processed through the point of purchase during the first 30 days after purchase; however this may vary depending on where you purchased the device – please check with your reseller.
If you need to claim warranty directly from Third Wave Power, please email a copy of your purchase receipt along with the serial number of the device and a description of the technical problem to firstname.lastname@example.org. If our customer support team determines that a higher level of support is required and you need to return the device, we will issue you with a Return Material Authorization (RMA) number. You will need to produce this RMA number when you visit your reseller to service the device. Warranty support is local to the country of original purchase.
The limited warranty stated herein is in lieu of all other express warranties. In no event shall any implied warranties, including but not limited to any warranties of merchantability, fitness for a particular purpose or non-infringement, extend beyond the applicable warranty period identified in paragraph 1 above. Some countries/states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from country to country/state to state.
Exclusive remedy, limitation of liability
The foregoing provisions state Third Wave Power Pte Ltd entire liability, and your exclusive remedy, for any breach of warranty, express or implied. In no event will Third Wave Power be liable for any consequential or incidental damages arising from any user or malfunction of any Third Wave Power device, or from any breach of warranty, including damage to other devices. In no event will Third Wave Power’s liability for any claim, whether in contract, warranty, tort (including negligence and strict liability) or under any other theory of liability, exceed the amount paid by you for the Third Wave Power device. Some countries/states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
